EN # Regulations for registering global domains.
§1 General Provisions
- These rules, hereinafter referred to as the “Rules,” define the principles of providing intermediary services in the registration of global domains and the subsequent administrative and technical support of domains, collectively referred to as the “Service,” by Smartx Technologies Ltd, headquartered in Cardiff, United Kingdom, at 7 Ty Nant Court, CF15 8LW, registered in the Companies House under number 12964587, hereinafter referred to as “Smartx Technologies” or the “Intermediary.”

§2 Definitions
- Registry – an entity managing a domain, performing registration and maintenance of domain names, and other activities related to domain names, in accordance with the regulations applied by the Registry.
- Registrar – an entity with the status of an official domain registrar, accredited by the relevant Registry, which may act on behalf of the Intermediary as an intermediary between the Client and the relevant Registry.
- Service – the intermediary service in the registration of domain names and the subsequent administrative and technical support of domain names provided by the Intermediary.
- Client – an individual, legal entity, or organizational unit without legal personality, using the Intermediary’s Services.
§3 Conditions for Registering gTLD Domain Names
- Top-level domains (gTLD) are intended for global use and are managed by various registries, depending on the specific gTLD.
- Detailed information about blocked names and the name reservation process can be obtained directly from the relevant registries.
- The most popular gTLD domains are:
- .com
- .net
- .org
- .info
- .biz
§4 Requirements for Registering gTLD Domains
- To register a gTLD domain, the applicant does not need to meet any specific residency requirements. gTLD domains are available to users worldwide.
- The domain name may consist only of letters (A-Z), numbers (0-9), and hyphens, except when the hyphen is at the first or last position in the domain name.
- The domain name cannot contain special characters, such as &, #, $.
- The domain name cannot be on the list of reserved or blocked names in the Registry.
§5 Registration of gTLD Domain
If the requirements for registering gTLD domains are met, the following general domain registration rules apply:
- By placing an order for domain registration, the Client authorizes Smartx Technologies to submit this order to the relevant registry or registry partner authorized to register the domain. If the Client decides to renew the domain, Smartx Technologies will forward this information to the relevant registry or registry partner.
- Smartx Technologies is not a domain registrar but acts as an intermediary in the registration process based on agreements with registries or their partners. This provision also applies when Smartx Technologies obtains the status of a registry partner.
- The regulations of Registries and Registry Partners and their privacy policies are available on their websites. Links to those documents are published in the Annex no 1.
- According to domain registration rules, user data is transferred to the WHOIS database.
- Until the user starts using the domain, Smartx Technologies reserves the right to place information on the domain address indicating that the domain has been registered through Smartx Technologies and that technical support is provided by this company. This information may include the Smartx Technologies logo and a link to their website.
- The Client grants the registry partners power of attorney to perform on their behalf activities related to registration, maintenance, change of subscriber, deletion of the domain, and management of domain data.
- The Client also grants power of attorney to Smartx Technologies to perform these activities when the company obtains the status of a registry partner. The Client agrees that Smartx Technologies will carry out all legal activities related to the registration and maintenance of the domain.
- The Client grants Smartx Technologies permission and power of attorney to perform all necessary activities related to the registration and maintenance of the domain, including obtaining the AuthInfo code and transferring domain management to another registry partner.
- This power of attorney also applies when Smartx Technologies becomes a registry partner and intends to transfer domains from another registry partner.
- These powers of attorney enable the execution of orders and instructions submitted by the Client within the services, ensuring their optimal execution.
§6 Right to Refuse Domain Registration
- Smartx Technologies reserves the right to refuse domain registration in the following cases:
- The domain is already registered.
- The registry refuses to register the domain based on its regulations.
- The domain name contains illegal content.
- The domain name is on the list of reserved and blocked domains. The full list can be found on the relevant registry’s website.
- After placing an order for domain registration, the domain is not reserved. The “first come, first served” rule applies. Smartx Technologies will register the domain within 24 hours of receiving a paid order. The payment date is not the domain reservation date, and Smartx Technologies does not guarantee its availability at the time of payment. If another person registers the domain during this time, Smartx Technologies may immediately terminate the registration agreement.
- In case of non-payment for domain registration within 10 days of placing the order, Smartx Technologies may immediately terminate the agreement. If another person registers the domain during this time, Smartx Technologies will refund the payment within 14 days.
- Termination of the agreement may also be issued via a message in the subscriber’s account.
§7 Liability
- Smartx Technologies is not responsible for the actions and omissions of the Registries, including the refusal to register or renew a domain name.
- Smartx Technologies is not liable for damages resulting from the malfunctioning of ICT systems beyond Smartx Technologies’ control.
- Smartx Technologies is not liable for:
- Blocking or deleting a domain name by the Registry and its potential acquisition by a third party.
- Registration of a domain name in bad faith.
- Claims to a given domain name by third parties.
- Changes in the domain name configuration or deletion of the domain name by an unauthorized person resulting from the Client providing the login, password, or access data to the Client’s Account to third parties.
§8 Final Provisions
- Smartx Technologies reserves the right to amend these Rules. Any changes to the Rules will be communicated to the Client by publishing the new version of the Rules on the Smartx Technologies website.
- These Rules are part of the Smartx Technologies Regulations available at https://docs.smartxhosting.uk/.
- Matters not regulated by these Rules are governed by the laws in force in the United Kingdom.
- The Rules come into effect on 1st July 2024.
